The rules for using Flock Clocker, and a plain statement of what we are and are not responsible for.
Agreement to these terms
Flock Clocker is a civic-records transparency tool published by Crossroads Technologies, LLC ("Crossroads", "we", "us"). By using the Flock Clocker app, website, or any information they present (together, the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.
What the Service is, and what it is for
The Service organizes and displays information drawn from public records: government procurement filings, public meeting records, openly licensed community map data, and official agency statements. It exists for civic transparency, journalism, research, and public understanding of government surveillance infrastructure and the public money that pays for it. It maps infrastructure and public spending, not people.
The Service presents historical, generalized public-records information. It is not a real-time or operational tool. The information is provided for general informational and transparency purposes only. It is not legal advice, not investigative advice, and not a substitute for verifying anything against its original public source.
You are responsible for how you use this information
You, and only you, are responsible for what you do with the information the Service provides. The Service is offered as a public-transparency record; the choices anyone makes with it are their own. We prohibit unlawful and harmful use (see Acceptable use below), and to the fullest extent permitted by law we take no responsibility and accept no liability for how any person uses, interprets, relies on, or acts on the information, including any use that violates these terms or the law.
You use the Service and any information from it entirely at your own risk, and you assume full and sole responsibility for any decision or action you or anyone else takes based on it.
Acceptable use
You agree to use the Service only for lawful purposes. You will not use the Service, or any information from it, to:
- break any law, regulation, or court order;
- harass, stalk, intimidate, threaten, endanger, or interfere with any person, including any law-enforcement officer or public employee;
- evade, obstruct, or interfere with a lawful investigation or law enforcement, or to facilitate any crime;
- damage, tamper with, or interfere with any camera, equipment, or property;
- scrape, resell, or redistribute the data in bulk except as the underlying licenses expressly permit.
The Service does not provide, and is not designed to provide, exact camera positions, real-time tracking, notifications timed to a device's location, or any navigation, routing, or feature intended to avoid, evade, or defeat cameras or law enforcement. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Public records can be incomplete, outdated, or wrong, and inferences drawn from them can be mistaken. We do not warrant that the information is accurate, complete, current, or fit for any purpose. If you believe a record is wrong, every record is disputable through our Corrections channel.
Limitation of liability
To the fullest extent permitted by law, Crossroads Technologies, LLC, Flock Clocker, and their owners, members, employees, and contributors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, reputation, or goodwill, arising out of or relating to your use of, or inability to use, the Service or the information it provides, or to any action any person takes based on that information, whether the claim is based in contract, tort, statute, or any other theory, and even if we have been advised of the possibility of such damages. These limits apply even if a remedy fails of its essential purpose. Our total liability for all claims arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim arose or one hundred US dollars (100 USD).
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, gross negligence, or personal injury or death caused by our negligence. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the above may not apply to you. In that case, our liability is limited to the smallest amount the law allows.
You agree to indemnify us
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Crossroads Technologies, LLC, Flock Clocker, and their owners, members, employees, and contributors from and against any claim, demand, damage, loss, liability, cost, or expense, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your violation of these terms, or your violation of any law or the rights of any other person.
Not a government service, and not affiliated
Flock Clocker is an independent, private civic-transparency project. It is not a government entity or service, and it is not affiliated with, endorsed by, or sponsored by any government agency, law-enforcement agency, or camera vendor or operator, including any company whose products or contracts are referenced in the records we cite. Product, agency, and company names are used only to identify the public records they appear in.
Data sources and attribution
Map data and community sightings are from OpenStreetMap. Map data (c) OpenStreetMap contributors, licensed under the Open Database License (ODbL): openstreetmap.org/copyright. Our procurement and public-records dataset is compiled by Crossroads Technologies, LLC from public sources, with each record citing its origin. See Methodology and Provenance for the full account.
Subscriptions
Paid subscriptions offered in the app are auto-renewable and are governed by the standard Apple Terms of Use (EULA): apple.com/legal/internet-services/itunes/dev/stdeula, and, on Android, by the Google Play terms. Subscriptions renew automatically until you cancel. You manage or cancel a subscription in your app store account settings, and cancellation takes effect at the end of the current billing period. Except where the law or the app store's policy requires otherwise, payments are not refundable.
App store terms
These terms are between you and Crossroads only, not with Apple or Google. Apple and Google are not responsible for the Service or its content, and they have no obligation to provide support for it. To the extent an app store's terms give Apple or Google rights as a third-party beneficiary of these terms, Apple and Google may enforce them. If anything in these terms conflicts with the app store's terms for a purchase you make through that store, the app store's terms control for that purchase.
Third-party links and sources
The Service links to public records, source documents, and other websites we do not control. We provide these links for reference only, and we are not responsible for the content, accuracy, or practices of any third-party site or source.
Copyright and takedown
If you believe content on the Service infringes your copyright, send a notice to our designated agent at [email protected] with the information required by 17 U.S.C. 512(c)(3): identification of the copyrighted work, identification of the material you believe infringes and where it is on the Service, your contact information, a statement of your good-faith belief that the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act. We respond to valid notices as the Digital Millennium Copyright Act requires. To dispute the accuracy of a public-record entry rather than a copyright, use our Corrections channel instead.
Governing law and venue
These terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in Codington County, South Dakota, and you consent to the personal jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. When we do, we will change the "Last updated" date above, and for material changes we will give reasonable notice through the Service before they take effect. Continuing to use the Service after a change takes effect means you accept the updated terms.
Suspension and termination
We may suspend or end your access to the Service at any time, with or without notice, if you violate these terms or if we stop offering the Service. The sections that by their nature should continue, including the disclaimers, the limitation of liability, the indemnification, and the governing-law and venue sections, survive any termination.
Age requirements
The Service is not directed to children. You must be at least 13 years old to use the Service, and at least 18 years old, or the age of majority where you live, to buy a subscription. If you are under 18, use the Service only with a parent or guardian involved.
Severability
If any provision of these terms is held unenforceable, that provision will be limited or removed to the smallest extent necessary, and the rest of these terms will stay in full force and effect.
Entire agreement
These terms, together with any terms they reference, are the entire agreement between you and Crossroads about the Service, and they replace any earlier agreements or understandings about it. Our failure to enforce any provision is not a waiver of that provision or of any other.
Assignment
You may not assign or transfer these terms or any right under them. We may assign these terms, in whole or in part, to any successor or affiliate, including in connection with a merger, acquisition, or sale of assets.
